Marrying in Spain from Denmark: certificates, residence and the alternative
What Spanish law and the Danish authorities require, which certificate to request in Denmark and the alternative of marrying at home and celebrating in Seville.
Short answer. To have a civil wedding in Spain, at least one of you must have a legal residence here; the Danish Embassy in Madrid says the same. If you live in Denmark, the usual route is to marry there and hold a symbolic ceremony in Seville. If you want the marriage itself to be Spanish, the Danish Ministry of Foreign Affairs says that in most countries you must show that you are not already married, with a Danish certificate (ægteskabsattest or civilstandsattest).
This guide gathers what the official pages say, with a link to each. Where I have not found an official source, I do not claim it.
Can a Danish couple have a civil wedding in Spain without living here?
Under Spanish law, not through the ordinary civil route. Article 58 of the Civil Registry Act (Ley 20/2011, text in force since 3 April 2025) says that the notary handles the prior record at the place of residence of either of the spouses, and that the file is handled by the court clerk (letrado de la Administración de Justicia) or the Civil Registry of the residence of one of them.
The Danish Embassy in Madrid says it in other words: at least one of you must have a fixed residence in Spain, so you cannot marry during a holiday. Some law firms say otherwise on their websites; I stick to the law and the official guidance.
Which certificate to request in Denmark
According to the Danish Ministry of Foreign Affairs, anyone marrying abroad must contact the authorities of the country where the wedding takes place, which know their own rules. The Danish marriage certificate (ægteskabsattest) or civil status certificate (civilstandsattest) confirms that you can marry without Danish law preventing it, and who issues it depends on your connection to Denmark:
- The municipality (kommune) if both of you are Danish or Nordic citizens, or have unlimited residence in Denmark. If you have never lived in Denmark, the City of Copenhagen.
- Familieretshuset, the state family law agency, if either of you does not meet those conditions.
The Spanish authorities may ask for the certificate to be translated and legalised. According to the Ministry, in some countries the Danish Ministry of Foreign Affairs legalises the certificate before you travel.
What the Danish Embassy in Madrid says
According to its page «Indgåelse af ægteskab i Spanien», Danish citizens marrying in Spain must present: a birth or baptism certificate less than six months old; a certificate of single status and capacity to marry (Fé de Soltería y Capacidad Matrimonial), which the Embassy issues for a fee on seeing a civil status certificate from a Danish municipality; a passport; and an application form provided by the local Spanish civil registry. The documents must be translated into Spanish by a sworn translator and carry the Hague Apostille, which the Danish Ministry of Foreign Affairs provides. When you file the application at the civil registry you need a witness who knows the couple and, if nobody speaks Spanish, an interpreter.
The alternative: marry in Denmark and celebrate in Seville
Many couples choose this route: you marry legally where you already live and in Seville you hold the ceremony you imagine, with an officiant, vows and family. That ceremony has no legal effect in Spain, which is why it needs no apostilles, sworn translations or certificates. I explain it in more detail in the article on the myths about marrying in Spain from abroad. I have summarised the usual list of documents in the guide to the legal requirements for marrying in Andalusia.
What I do and what you do
I accompany you through the process: I explain what is asked, coordinate appointments and documents with the authorities and make sure you do not queue at the wrong window. I do not replace the Civil Registry, a notary, your consulate or a lawyer. The documents from your country and the steps that require you to appear in person are yours to do.
