A Spanish wedding from Sweden: the hindersprövning and the rest of the paperwork
What Spanish law and the Swedish authorities require, what the hindersprövning is and when to marry at home and celebrate in Seville.
Short answer. To have a civil wedding in Spain, at least one of you must have a legal residence here. If you live in Sweden, the usual route is to marry there and hold a symbolic ceremony in Seville. If you want the marriage itself to be Spanish, the Swedish party must first go through a hindersprövning (a check that there are no impediments): Skatteverket, the Swedish Tax Agency, does it if you are registered in Sweden, and afterwards you can request the marriage certificate in Spanish.
This guide gathers what the official pages say, with a link to each and its date. Where I have not found an official source, I do not claim it.
Can a Swedish couple have a civil wedding in Spain without living here?
Under Spanish law, not through the ordinary civil route. Article 58 of the Civil Registry Act (Ley 20/2011, text in force since 3 April 2025) says that the notary handles the prior record at the place of residence of either of the spouses, and that the file is handled by the court clerk (letrado de la Administración de Justicia) or the Civil Registry of the residence of one of them. Some law firms say otherwise on their websites; I stick to the law and the official guidance.
The Swedish Embassy also asks you to contact, in good time, the Civil Registry of the municipality where the wedding will take place, to learn the current requirements and documents.
The hindersprövning: what it is and who does it
According to the page «Vigsel inför spansk myndighet» of the Swedish Embassy in Spain (updated 17 September 2026), a Swedish citizen who wants to marry before a Spanish authority must first pass a hindersprövning. What it says:
- Only the Swedish party is examined. The foreign party hands in their own documents to the Spanish authority.
- If you are registered in Sweden, the check is done by Skatteverket. Afterwards you can request the marriage certificate (äktenskapscertifikat) in Spanish, through the Embassy or an honorary consulate, for a fee.
- If you have been deregistered from Sweden and live permanently in Spain, the check is done by the Embassy in Madrid, which issues the certificate in Spanish.
- Documents to apply at the Embassy or consulate: the form «Äktenskapscertifikat, ansökan och försäkran»; a Swedish population register certificate (personbevis) showing the deregistration date, parents' names and civil status, with the bilingual EU annex and no more than three months old; valid ID for both of you (passport or ID card; a driving licence is not accepted); and the Spanish NIE, if applicable.
- Time and validity: about two weeks from when the application is complete and paid, and the certificate is valid for four months.
- European recognition: since 16 February 2019, according to the Embassy, Spanish authorities must accept the Swedish personbevis and marriage certificate with their bilingual annex.
The Swedish Embassy and consulates handle the check and issue the certificate, but they do not decide whether the wedding is valid in Sweden.
After the wedding
The Embassy says that, after the ceremony, it has to be registered with Skatteverket, sending a certified copy of the wedding document and, if the spouse was never registered in Sweden, a copy of their passport. Skatteverket assesses whether the wedding is valid in Sweden and, if it is, enters it in the population register.
The alternative: marry in Sweden and celebrate in Seville
Many couples choose this route: you marry legally where you already live and in Seville you hold the ceremony you imagine, with an officiant, vows and family. That ceremony has no legal effect in Spain, which is why it needs no apostilles, sworn translations or certificates. I explain it in more detail in the article on the myths about marrying in Spain from abroad. I have summarised the usual list of documents in the guide to the legal requirements for marrying in Andalusia.
What I do and what you do
I accompany you through the process: I explain what is asked, coordinate appointments and documents with the authorities and make sure you do not queue at the wrong window. I do not replace the Civil Registry, a notary, your consulate or a lawyer. The documents from your country and the steps that require you to appear in person are yours to do.
